1. Who we are

Staymark ("we", "us", "our") is a residency day-tracking service, on the web at staymark.co.uk and as an app for iPhone and Android, operated by Jadthena Ltd, a company registered in England and Wales. These terms apply when you use the website, the web tracker or the app. By using Staymark you agree to them.

2. What Staymark does — and does not do

Staymark counts the days you log and applies published thresholds: the Schengen 90/180-day rule, the day counts in the UK Statutory Residence Test and the US substantial presence test. It shows what those counts mean against each threshold.

Staymark is not tax, legal or immigration advice. Its results depend entirely on the trips you enter, it does not verify your travel, and border officers and tax authorities make their own decisions. Confirm your position with a qualified professional before you rely on it.

3. Your data

In the app and in the web tracker without an account, your trips stay on your device. If you create an account, we store your trips so you can see them on any device. How we handle personal data is set out in our Privacy Policy.

4. Free and Premium

The day counters, the "Can I go?" planner, the forecast and CSV export are free. Staymark Premium adds the PDF evidence pack and unlimited profiles, and in the app, limit alerts. Premium is a subscription: £3.99 a month or £24 a year in the UK. Prices in other countries are shown in your local currency before you buy.

Buying in the iPhone app

Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple ID settings (Settings → your name → Subscriptions). Refunds for App Store purchases are handled by Apple under its own policies. Use of the iPhone app is also subject to Apple's Licensed Application End User License Agreement.

Buying in the Android app

Payment is charged to your Google Play account. Your subscription renews automatically unless you cancel it in the Play Store (Profile → Payments & subscriptions → Subscriptions) before the renewal date. Refunds for Google Play purchases are handled under Google Play's policies.

Buying on the web

Payment is taken by card through Stripe. Your subscription renews automatically until you cancel; you can cancel at any time from the Premium page of your web account (Manage billing, change plan or cancel), and Premium stays on until the end of the period you have paid for.

A purchase in one place unlocks Premium where you bought it. Nothing in these terms affects your statutory rights as a consumer.

5. Fair use

Don't misuse Staymark: no attempts to break, overload or reverse-engineer the service, no access to other people's accounts, and no use that breaks the law. We may suspend an account that does.

6. Availability and changes

We work to keep Staymark running and accurate, and we update the rules when the published thresholds change, but we can't promise the service will always be available or error-free. We may change features or these terms; the "Effective" date above shows the latest version. If a change affects a paid subscription, we will tell you before it takes effect.

7. Liability

Staymark is provided as a day-counting tool. We are not liable for decisions you or anyone else make based on its results, or for indirect or consequential loss. Our total liability to you is limited to the amount you paid us for Premium in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

8. Ending

You can stop using Staymark at any time. In the app, deleting the app deletes your trips from the phone. If you have an account, email us and we will delete it, as our Privacy Policy explains.

9. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep any mandatory consumer protections of where you live.
